Company Data Download: PSC Exempt

Will there ever be the case where in the Company Data Download, Companies House can pass down ‘PSCExemptAsTradingOnRegulatedMarket’ = True, but in the same document also provide a Company Statement or PSC if they happen to still exist on the Companies House database for that company?

Currently the data will be returned if either of the PSC exempt flags are set to true but that is a bug which will be fixed early next week. The data will not be returned as is no longer being kept up to date by the company. Hope that helps

Furthermore, in the scenario where Companies House knows the company to NOT be PSC Exempt, and therefore Companies House may send a Company Statement or PSC in the data download. But since the last Confirmation Statement, the company has become PSC Exempt. In this instance, apart from populating the PSC Exempt flag to ‘True’ in the latest Confirmation Statement, should the company also withdraw the Company Statement or PSC in the same Confirmation Statement?

If there are no PSC changes to report and the only information due is to tell us about an exemption from Part 21A, there is no need to cease/withdraw existing PSC information.

The PSC information you file should be a copy of whatever is in your own register. Therefore, if a PSC ceases to be or a PSC statement ceases to be true before the company becomes exempt from Part 21A, the company should file a confirmation statement to tell us that. Unfortunately you cannot file PSC updates and tell us about exemption from Part 21A in the same software filed confirmation statement. Therefore, you would need to file the information in separate confirmation statements. If you wanted to tell us about an exemption and file PSC information in the same confirmation statement you could do so by filing on paper.

If filing of both PSC updates and changes to Part 21A exemption in the same confirmation statement is acceptable by paper, but not by electronic means, is the obstacle a technical one that’s likely to be corrected by Companies House at a future date?

We are considering how best to allow for this scenario whilst ensuring companies with an exemption from Part 21A don’t enter PSC information when they shouldn’t.

Can I ask did this bug get fixed, so that now if the Companies House record states that a company is PSC Exempt, and if, by some circumstance, the Companies House record also happens to have a PSC Company Statement or PSC Notification for that company, then the PSC Company Statement or PSC Notification will NOT be passed down in the Company Data Download?
